PRIVACY STATEMENT BETWEEN USER AND KUHNSOFT, LLC (DBA FOODTRUCK.PUB / FOOD TRUCK PUB)

KUHNSOFT, LLC (DBA FOODTRUCK.PUB / FOOD TRUCK PUB) is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Statement of Privacy applies to the Food Truck Pub site and governs data collection and usage. By using the Food Truck Pub site, you consent to the data practices described in this statement.

COLLECTION OF YOUR PERSONAL INFORMATION

For consumers ordering food, Food Truck Pub collects (in the category of personal information), personally identifiable information as follows: name, email address, home or work address (for delivery orders only), and telephone number (to alert you when food is ready for pickup/delivery, or to call you in case there is an issue with your order) This information is to make the food truck ordering system work properly and so we can identify you for your food order. We also temporarily collect, but do not save, your geocoordinates (latitude/longitude) so we can find trucks that are closest to you.

For food trucks, we collect all of the above information from you as well as collect and save your geocoordinates in our database so we can identify consumers that are closest to you and so they can place their orders with you.

For food truck owners, providing your Mobile Phone number, allows us to notify you of new orders as well as give you assistance with your setup and technical support of the system.

For food truck owners using our Facebook integration which allows us to post your information to your Facebook page based on your activity in Food Truck Pub, the following information is the only information stored in our database: Authentication randomly generated OAuth Page Access Token, Page Name, and Page ID. We do not store or lookup and store any other additional information about your Facebook page, nor do we lookup activity as it relates to comments and likes made against your Facebook page. We perform your confirmed posting text and it is up to you to ensure its accuracy if your truck schedule or location changes in which case you should manually edit your Facebook post directly in Facebook. We do NOT update your post afterwards based on you making edits to your activity in Food Truck Pub.

For customers, consumers ordering from food trucks, by providing your Mobile Phone number, you are opting in so that we can notify you whenever your food is ready for pickup (or delivery).

There is also information about your computer hardware and software that is automatically collected by Food Truck Pub. This information can include: your IP address, browser type, domain names, access times, referring website addresses, as well as location data so we can find and locate food trucks properly. This information is used by Food Truck Pub for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Food Truck Pub site. Our apps in the app stores will prompt for location access but will not collect background location data unless you upgrade to real-time location tracking and turn this feature on. We use location information to either find food truck nearby if you are a consumer as well as to pinpoint the location of your food truck if you are a food truck owner.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Food Truck Pub, this information may be collected and used by others.

You may notify us at any time to have your information purged from our system by sending us an email with your request to support@foodtruck.pub. Or, call us at +1 (412) 748-1025. Registered food trucks can also click on their User Profile and click the Close Account button to have their account deactivated and data purged.

Consumers in the state of California may request access to review, delete, or restrict the processing of their personal identifieable information collected through the app using the above-mentioned contact information.

Consumers who are minors, if we know they are minors, will have their information obfuscated/encrypted so that we only know an order was placed at a period of time and to a specific truck, but that no personal identifiable information can be extracted of that minor. If you are a minor or are parent or guardian of a minor that you know uses Food Truck Pub, you may request deletion and/or obfuscation of the minor's information at any time also using the previously mentioned contact information above.

This information is the only information we collect so that the food truck can identify your order and know that it belongs to you as well as can contact you in case there is a question or problem with your order. For minors under age 16, or anyone else for that matter, we do not collect any additional information other than this bare minimum needed in case the truck needs to contact you about your order.

By default, the above information is kept for a period of up to 3 years for accounting purposes by food trucks and for their bookkeeping and tax purposes.

Food Truck Pub encourages you to review the privacy statements of Web sites you choose to link to from Food Truck Pub so that you can understand how those Web sites collect, use and share your information. Food Truck Pub is not responsible for the privacy statements or other content on Web sites outside of the Food Truck Pub and Food Truck Pub family of Web sites.

USE OF YOUR PERSONAL INFORMATION

Food Truck Pub collects and uses your personal information to operate the Food Truck Pub Web site and deliver the services you have requested. Food Truck Pub also uses your personally identifiable information to inform you of other products or services available from Food Truck Pub and its affiliates. Food Truck Pub may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Food Truck Pub does not sell, rent or lease your 'customers' or 'customer lists' to third parties. Food Truck Pub may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you and communicate with you about value added offerings. In addition, Food Truck Pub may share data with trusted partners to help integrate with value-add services to provide additional functionality and benefit to food trucks using our platform such as selecting a payment provider to use with Food Truck Pub or mapping services to make you more visible when your truck is active. You may choose not to use these other like/similar services and may email us to have your data removed from these other services if you choose not to use them or they do not benefit you. We may also share data to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Food Truck Pub, and they are required to maintain the confidentiality of your information.

Food Truck Pub does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

Food Truck Pub keeps track of the Web sites and pages our customers visit within Food Truck Pub, in order to determine what Food Truck Pub services are the most popular. This data is used to deliver customized content and advertising within Food Truck Pub to customers whose behavior indicates that they are interested in a particular subject area.

We send periodic updates via email (newsletters) as well as order notification emails (invoices). You may unsubscribe to newsletters at any time using the Unsubscribe link provided within our periodic newsletters which often also contain important system updates and enhancements. However, we have the right to always email you related to information about your account as well as copy you on things related to the usage of this platform such as order invoices as your customers place orders.

Food Truck Pub Web sites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Food Truck Pub or the site; (b) protect and defend the rights or property of Food Truck Pub; and, (c) act under exigent circumstances to protect the personal safety of users of Food Truck Pub, or the public.

USE OF COOKIES

The Food Truck Pub Web site use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a Web page server. Food Truck Pub does not house or store sensitive information such as credit card details. These are transmitted real-time and are directly processed by a truck's selected payment provider such as Square, Clover, or PayPal. This sensitive data never gets stored on Food Truck Pub servers or databases and only refernces to your payment such as a Payment ID are stored in our platform.

Food Truck Pub will occasionally update this Statement of Privacy to reflect company and customer feedback. Food Truck Pub encourages you to periodically review this Statement to be informed of how Food Truck Pub is protecting your information.
